Your Face Is the Front Door. Systems Aren't Ready.

Facial recognition is being embedded into everyday platforms and government checkpoints at speed — but the consent, accuracy standards, and data governance behind these deployments are nowhere near ready for the weight they're now carrying.
That story broke the same week TSA's biometric expansion came under fresh legal scrutiny, and Alaska Airlines quietly rolled out facial ID verification at automated bag drops in Seattle and Portland. Three stories, three different sectors, one unmistakable pattern: face scanning isn't a specialty tool anymore. It's becoming the default front door. And nobody's asking whether the infrastructure behind that door was built to hold the load.
The Discord Situation Is Worse Than It Looks
Let's start with Persona. Partially funded by Peter Thiel's Founders Fund, Persona Identities provides age and identity verification for Discord, OpenAI, Lime, and Roblox — a client list that covers a significant chunk of the internet's younger user base. When researchers found Persona's front-end code exposed on a Google Cloud endpoint accessible from a U.S. government-authorized domain, what they uncovered wasn't just a sloppy security posture. It was a window into how much these systems are actually doing versus how much users think they're doing.

The files showed Persona was conducting facial recognition checks against watchlists, screening for "adverse media" across 14 categories — terrorism, espionage, and more — and assigning users risk and similarity scores. A Discord user sitting down to verify their age for access to an adult community server was, apparently, also being run through a system that flags politically exposed persons. Discord has since distanced itself from Persona. But the damage isn't just reputational — it's structural. The episode illustrates exactly how opaque the vendor layer is in most consumer-facing biometric deployments. The platform doesn't build the system; they contract it out. The contractor's methodology, thresholds, and data handling policies are buried in enterprise agreements most users will never read. And when something surfaces, the platform's first move is distance, not disclosure.
TSA's "Optional" Scans and the Theater of Consent
Meanwhile, at airports across the country, the TSA is expanding its use of Credential Authentication Technology–2 scanners — devices that capture a real-time image of your face and compare it against your government-issued ID. The agency calls the scans optional. McKenly Redmon of Southern Methodist University's Dedman School of Law calls that description aspirational at best.
Redmon's argument, detailed in a recent law review article, is that the opt-out exists in theory only. Travelers don't know they can refuse. The signage is vague. The TSA states it deletes the photos — except in "limited cases." What constitutes a limited case isn't spelled out. That's different from a 1:N identification system that matches your face against a large unknown database. But that distinction collapses when the comparison database is effectively universal — every passport holder, every driver's license — and participation is de facto required to board a plane. Alaska Airlines' announcement about its automated bag drop identity verification is, on its face, unremarkable. The airline is expanding a service it launched in San Francisco, Portland, and Seattle — now adding biometric ID verification to the process. The pitch is straightforward: faster, easier, no agent required.

Five minutes or less. That's the design goal. Not "accurate enough to survive legal challenge." Not "documented to evidentiary standard." Five minutes. And honestly, for checking a bag, that's probably fine — you're not building a court case on who dropped off a roller bag at SEA-TAC. But the language around these deployments matters, because it sets public expectations about what face scanning is and what it can do.
When the same technology that optimizes for five-minute bag drops gets treated as reliable identity evidence in other contexts, that's where things break down. Speed-optimized systems and evidence-grade systems are solving fundamentally different problems. An airport throughput system is engineered to minimize false negatives — it really doesn't want to let the wrong person through. An investigative-grade comparison reverses the priority entirely: a false positive — misidentifying a subject — is the catastrophic error. The methodology, documentation, and confidence thresholds required aren't just different in degree. They're different in kind.
Why This Matters for Investigators

A similarity score generated by Persona. A TSA biometric log. An airline ID verification timestamp. These are real data points, attached to real identities, produced by systems that were built for throughput, compliance, or fraud prevention — not for evidentiary weight. Knowing how a match was generated matters as much as the match itself. What algorithm produced the score? What confidence threshold triggers a "match" flag versus a "review" flag? Was the comparison 1:1 or 1:N? What were the lighting conditions at capture? What demographic group does the subject belong to, and has the algorithm's error rate for that group been documented? These are the questions that professional-grade face comparison is built to answer — with documented methodology, auditable thresholds, and output that can withstand challenge. Consumer and infrastructure systems aren't built to answer them at all. They're built to keep the line moving.
There's a fair counterargument here: a biometric record tied to a confirmed government identity is more durable than a handwritten log or a manual document check. That's true. Better infrastructure does create better data trails. But "better than the worst alternative" is not the same as "good enough to stake a case on." Investigators who treat output from throughput-optimized systems as case evidence are importing a tool built for a completely different risk model — and when that evidence gets challenged, the seams will show.

The systems generating that data were built for speed and scale, not evidentiary reliability. The investigator's job, increasingly, is knowing the difference between a data trail paved for throughput and one paved for court.
So as face scans at airports and platforms become routine — generating comparison data and risk scores that will eventually surface in legal proceedings, insurance investigations, and corporate disputes — here's the question worth sitting with: when Persona assigns a Discord user a similarity score based on a watchlist check, and that score shows up in discovery, who in that chain of custody can actually explain how it was calculated? Right now, the answer appears to be nobody. The code was sitting open on a cloud endpoint, and even the researchers who found it had to piece together what it was doing. That's not a foundation for evidence. That's a liability waiting to be deposed.
